Legal expert Sarah Luetto has now joined the conversation in conversation with Page six.

Speaking to the outlet, the lawyer claimed that a premarital NDA between Swift and Kelce would likely include “non-disparagement or non-disclosure terms related to their relationship.”

However, she believes Swift would ensure that any such agreement would not include provisions restricting a key aspect of her writing style.

“In Taylor’s case, she probably wouldn’t want to include provisions preventing her from singing about her relationship in songs, especially since there is always so much speculation about the subjects of her compositions,” Luetto said.

According to Luetto, each member of the couple can choose to include provisions clarifying what constitutes community or marital property, in order to “avoid future claims on their creative work.”

“For example, if Taylor had re-recorded one of her albums during her marriage, there would be an argument that the re-recording was in part a marital asset,” the lawyer told the outlet.

She also pointed out that the NDA may also include conditions governing how dissolution could be carried out if the marriage does not work out.

“They may include conditions requiring mediation or, in states where it is permitted, the use of a private judge for any dissolution proceedings,” Luetto said. “For a high-profile couple like Swift and Kelce, confidentiality provisions of this nature would be particularly helpful in shielding the details of any potential dispute from public scrutiny.”

She believes, however, that the duo could combine strengths in certain situations, such as when they choose to create a joint venture, and that it wouldn’t be too complicated if they included a simple legal provision.

“They would simply need to clarify their ownership interests in any jointly owned assets on a case-by-case basis,” Luetto explained.

“When one party is worth significantly more than the other, prenuptial agreements often provide that the wealthier party will pay all of the couple’s living expenses while the less wealthy party will preserve their separate estate,” the attorney revealed.

In addition to potentially covering some of Kelce’s living expenses, Swift can also choose to share a portion of his estate, if she chooses, as such arrangements are not uncommon in prenuptial agreements.

“The amounts transmuted or gifted often increase over time, reflecting the length of the marriage,” the lawyer added.
