The recordings, first reported by TMZdate back to November 2024 and were carried out when police interviewed the children shortly after concerns were raised.
During the interview, a police officer carefully structured the discussion by asking, “So you know what’s right and wrong, right?” Do you know that no one can touch your private parts?
The response that followed became central to Busfield’s defense.
One of the boys replied, “Yes, but he doesn’t touch those parts.” The other followed with an even firmer denial, stating, “No, he never touched me… ever.”

Busfield’s lawyers argue that these statements contradict later assertions and deserve new review.

How prosecutors and courts interpreted the first statements
Despite the content of the audio, prosecutors at the time concluded that the interview did not meet the threshold required to formally establish abuse.
The statements were classified as failing to “disclose” alleged misconduct, allowing the investigation to remain open while other investigations continue.
According to the arrest warrant, the case has evolved considerably almost a year later.
In October 2025, the children’s mother contacted Child Protective Services, reporting that a child had disclosed new information during therapy sessions.
This later account formed the basis of the criminal charges that now face the actor.

Court documents state that during therapy, a child alleged that Busfield touched his “genitals” and “buttocks” while they were alone in a room on the set of “The Maid.”
This assertion stands in direct contrast to the initial police interview that resurfaces today in court records.
Busfield’s legal team submitted the audio to a New Mexico court this week, describing it as evidence of an “unequivocal denial” of wrongdoing by the children from the earliest stage of the investigation.
Prosecutors argue that the late disclosure does not invalidate subsequent testimony, setting the stage for a contentious legal battle.
Busfield has pleaded not guilty to two counts of criminal sexual contact with a minor and one count of child abuse.

Separate from the case involving the twins, Busfield was also accused of sexually assaulting a third alleged victim, a 16-year-old girl.
According to filings, the incident occurred during an audition at Sacramento’s B Street Theater, which Busfield founded.
The motion states, in accordance with Daily Mail“During an audition for the defendant at the B Street Theater, the 16-year-old reported that he kissed her, put his hands down her pants, and touched her private parts.”
Other allegations in the filing allege that Busfield “begged the family not to report to law enforcement if he was in therapy,” with the girl’s father, described as “a therapist himself,” believing at the time that therapy was the appropriate response.
However, Busfield’s lawyers presented statements from another actor at the theater, Matthew Moore, which they say undermine the credibility of the prosecution.

According to court documents, Moore recalls a conversation with the alleged victim’s father that painted a disturbing picture of competing motivations.
The father allegedly told Moore, “They’re going to love it because Tim Busfield is going to introduce it to them, which I’m sure he will because he’s going to need it if he thinks he’s going to fuck my daughter.”
When Moore asked why the father thought Busfield was interested in his daughter, the answer was reportedly straightforward: “Because she’s a real girl.”
Busfield’s legal documents argue that these remarks suggest an attempt to take advantage of the situation to advance his career.
As the legal drama unfolds, the professional consequences for Timothy Busfield have intensified. Amazon MGM has removed him from the upcoming romantic comedy “You Deserve Each Other.” The film, which stars Penn Badgley, Justin Long and Kyle MacLachlan, completed production before the allegations became public.
