The Georgia teenager who criminal charges avoided after running over and killing a math teacher should not be criminally charged because he was driving safely, according to his lawyer.
Jayden Wallacethe lawyer, Graham McKinnontells TMZ… Wallace, 18, was not driving his van “in a dangerous or dangerous context” when he left his “mentor’s” home, Jason Hughesafter toilet papering Hughes’ property with his friends.
As a result, McKinnon says it’s not “appropriate to charge a felony” because it was a simple accident. Wallace was arrested and convicted of vehicular homicide after the March 6 tragedy.

But the Hall County prosecutor decided Friday not to pursue criminal charges against Wallace or his friends after Hughes’ wife announced she did not want them prosecuted, calling the incident a tragedy.
McKinnon told us that Wallace and his buddies “loved” Hughes, a math coach and teacher at North Hall High School in Gainesville, Ga., where the teens are enrolled.
The lawyer also claims the teens weren’t playing a prank on Hughes, but rather were playing a “complicated game” with the toilet paper.

McKinnon referenced the fact that the teens did not throw eggs or shoot paintballs at Hughes’ house to try to explain why the game was complicated, although his rationale was unclear. He also criticized the media for perpetuating the “farce” narrative.
Meanwhile, McKinnon says Wallace is “torn apart by the loss of his mentor”, to whom he was “very close”. The attorney said Wallace hung out in Hughes’ class and became involved in a Christian organization Hughes started.
