Suspected Murder: Court Blocks Police From Arresting Ebonyi APGA Gubernatorial Candidate

A High Court sitting in Abakaliki, the capital of Ebonyi State, has prevented Nigerian police from arresting the state’s Progressive Grand Alliance (APGA) gubernatorial candidate, Professor Bernard Odoh for the murder of his traditional leader Umuezeokoha, HRH, Ezeogo Christopher Igboke Ewa.

The court presided over by the state's Chief Justice, Judge Elvis Ngene, blocked police from arresting Odoh on Friday.

Ewa, who is also the Chairman of the Council of Traditional Rulers of Ezza, was assassinated on Monday night at his palace in Umuezeokaha Community in the State's North Ezza Local Government Area by assassins unknown and police said Odoh was wanted following a petition filed against him by some family members.

Meanwhile, a High Court in Owerri prevented police from arresting him last week.

However, in a case brought in the Abakaliki 1 High Court by one of the deceased monarch's sons, Prince Igboke Collins Emeka against Professor Benard I. Odoh, Commissioner of Police of Ebonyi State and Inspector General of Police, seeking an order of mandamus to arrest and try the former SSG, the petitioner applied to the court for an order of mandamus directing the CP and IGP to immediately arrest Professor Odoh to respond to the alleged involvement in the murder of HRH Ezeogo C. Ewa.< /p>

Odoh Council, led by C.K. Okorie, Esq challenged the court's jurisdiction to hear the claim.

After hearing the motion for jurisdiction and the action on the merits, the court ordered the police to first conduct a thorough and independent investigation into the complaint and if anyone is found guilty of the alleged murder, this person must be arrested.

The court refused to order the arrest of Professor Odoh as requested by the petitioners.

Reacting to the decision, one of the lawyers for the 1st defendant, (Prof. Benard I. Odoh); Sir Petrus I. Elechi, Esq applauded the judgment of the court and appreciated the judgment of the court and for not allowing the court to be used as a political witch hunt tool.

He expressed his joy that the court stood on the path of the rule of law, ordering the police to carry out a thorough and independent investigation into the case before arresting anyone found guilty.
