Declaration of illegal results: Binani urges court to stay proceedings against suspended REC

The All Progressives Congress (APC) gubernatorial candidate in the last elections in Adamawa State, Aishatu Dahiru, also known as Binani, on Monday urged the Federal High Court in Abuja to allow the state-seated Electoral Petitions Court to issue judgment before the suspended Resident Electoral Commissioner (REC), Hudu Ari, is prosecuted.

Ms. Dahiru told the Judge, Donatus Okorowo, through her attorney, Chiesonu Okpoko, a Senior Advocate from Nigeria (SAN), while adopting the procedures filed regarding her lawsuit.

The News Agency of Nigeria (NAN) reports that Binani had, in a lawsuit marked: FHC/ABJ/CS/935/2023, sued the Independent National Electoral Commission (INEC), the Inspector General (IGP) of Police and the Attorney General of the Federation (AGF) as 1st to 3rd defendants respectively.

In the lawsuit, the plaintiff sought interpretation of section 144 of the Elections Act 2022 and a protective order requesting that the parties maintain the status quo with respect to the charges brought by INEC against M. pending the hearing and decision of the prosecution.

INEC had filed six counts against Mr. Yunusa-Ari in the Adamawa State High Court in Yola, the state capital, after police concluded investigations into his unlawful declaration of Binani as the winner of the gubernatorial election at a time when the returning officer charged with the responsibility of making such declaration had yet to conclude the filing.

Binani's lawyer, Michael A ondoaka, SAN, in the ex parte petition previously filed and granted by the court on July 10, brought to the attention of the judge that a petition was before a petition court for the Adamawa State elections and would be dismissed within 180 days as required by law.

The court has ordered the parties to the action to stay the action in the matter and has scheduled a hearing in the main action for today (Monday).

Binani's Arguments

When the hearing resumed on Monday, Mr. Okpoko, who stood in for Binani's lead attorney, Mr. Aondoaka, told the judge that Mr. Yunusa-Ari, who was to be prosecuted for his election action, was a star witness for the APC candidate in the Electoral Claims Tribunal.
