The New Nigeria Peoples Party (NNPP) Senate candidate for Bauchi State, Kabiru Mohammed has dragged the party and the Independent National Electoral Commission (INEC) to a Federal High Court for allegedly refusing to publish his name for the 2023 general election election after winning the party primary.

The case was filed in the Federal High Court, Bauchi and was first listed for hearing on Monday, September 26, 2022.

The controversy is over who is the legitimate NNPP candidate to run in the 2023 general election to represent the federal constituency of Katagum in the House of Representatives.

Kabiru Mohammed is seeking an injunction prohibiting the 3rd defendant, Ibrahim Mohammed Babas, from running as the NNPP candidate for the Katagum Federal Constituency in the House of Representatives in the 2023 elections.

Kabiru contested the party's primary election but lost to Ibrahim Mohammed Babas who did not participate in the party's primary due to his participation in the Bauchi North senatorial contest under the All Progressives platform Congress APC.

Kabiru, who contested the primary election and won, went to court to challenge the party's attempt to steal his mandate after INEC recognized Ibrahim Mohammed Babas as a candidate for the Federal House of Representatives of Katagum in the State.

Shortly after the case was mentioned to be heard at the Federal High Court in Bauchi, Kabiru Mohammed said that Ibrahim Mohammed Babas decamped to the NNPP when he lost the senatorial primary election under the platform. -form of the APC.

"My party has submitted its name to INEC as a candidate for the Federal House of Representatives in Katagum, but I will leave no stone unturned in my quest to regain my mandate. I have resolved not to stand down of the race under no pretext because the mandate was duly given to me by the members of my party”

“I am the elected candidate of the party and I will not stand down for anyone because by right the mandate was given to me by members of our great party. this as undemocratic, illegal and of course inhumane. This is why I challenged their action in court,” he said

When the case was mentioned earlier in the Federal High Court, Bauchi, the applicant's lawyer Hassan ElYakub, Senior Advocate for Nigeria (SAN), explained that there was a problem of representation because two lawyers appeared for the second accused.

However, a different motion was filed by the second defendant, saying they wanted to withdraw one of the charges, but the defendants' attorney, Habila Barau, said they had been informed by the second defendant to take over the case from the attorney who earlier filed the case.
