Two federal agents fired their weapons during The Fatal Shooting of Alex Prettiaccording to an initial Department of Homeland Security review obtained by NBC News.
The preliminary report, from a Customs and Border Protection office An internal investigation by the agency’s Office of Professional Responsibility was sent Tuesday to congressional committees, including the House Homeland Security and Judiciary committees, according to three sources.
The report states that during the Jan. 24 encounter, an officer yelled “He has a gun!” ” several times, then “about five seconds later, a BPA [Border Patrol agent] unloaded his CBP-issued Glock 19 and a CBPO [Customs and Border Protection officer] also unloaded his CBP-issued Glock 47 at Pretti.
The report does not specify whether bullets from the two officers’ weapons struck Pretti.
The report also made no mention of Pretti’s attacks on officers or police. brandish a gunas Secretary of Homeland Security, Kristi Noem claimed the day after the shooting.
Multiple recorded videos by eyewitnesses verified and analyzed by NBC News show Pretti was not holding a weapon during the struggle because he was surrounded by officers. Video shows a federal agent remove a gun from Pretti’s waist just before he was shot.
The report states that after the shooting, a Border Patrol agent said he was in possession of Pretti’s gun, which was then secured in his vehicle.

The report said its findings were based on CBP documents and body cameras of officers at the scene.
He said officers were “conducting enforcement actions” in Minneapolis Saturday morning as part of Operation Metro Surge, near the intersection of Nicollet Avenue and 25th Street.
The operation saw some 3,000 federal officers and agents deployed to Minnesota — the Minneapolis Police Department has just 600 officers — as part of President Donald Trump’s crackdown on migrant communities and what federal officials see as an attempt to root out local corruption and fraud.
This rise in power was met with strong opposition and local protests, particularly after a local woman, Renee Good, was shot by an immigration officer while she was driving her car on January 7.
“Several civilians were in the area shouting and whistling. BPA and CBPO repeatedly asked civilians to stay on sidewalks and off the roadway,” the report on Pretti’s death states.
A police officer was then “confronted” by two women who were whistling and who had not obeyed orders to get off the road, according to the report. After the officer pushed them both away, one of them ran toward a man the report identified as Pretti.
The officer continued to attempt to move the woman and Pretti off the road before using his pepper spray on both of them, according to the report.
“CBP personnel attempted to arrest Pretti. Pretti resisted the efforts of CBP personnel and a struggle ensued. During the struggle, a BPA yelled, ‘He has a gun!’ several times,” the report said.
About five seconds later, a Border Patrol agent and a CBP officer both shot Pretti, according to the report.
At 9:02 a.m., CBP personnel cut off Pretti’s clothing and gave him first aid, including placing seals on his wounds, before firefighters arrived two minutes later, according to the report.
