The Senate is required under Section 154 of the 1999 Constitution to select persons appointed to serve as National INEC Commissioners and Resident Election Commissioners.

The provision reads as follows: "Except in the case of ex-officio members or where other provisions are provided for in this Constitution, the president and members of any of the bodies as well shall, subject to the provisions of this Constitution, be appointed by the President and the appointment shall be subject to the confirmation of the Senate."
