2023: Akwa Ibom APC government aspirant wants court to jail his opponent for alleged perjury

An All Progressives Congress (APC) leader, Ita Enang, on Tuesday begged a Federal High Court (FHC) in Abuja to incarcerate his rival for the APC governorship in Akwa State Ibom, Akanimo Udofia, in prison for alleged perjury.

Mr. Enang, who participated in the May 26 APC gubernatorial primary in Akwa Ibom, made his claim while presenting his case before Justice Emeka Nwite.

He told Judge Nwite that Mr. Udofia, who also participated in the survey, lied in court by filing an affidavit of non-multiplicity of action despite similar action before an FHC Uyo.

He said that for “lying under oath” in violation of FHC practice guidelines, Mr. Udofia should be incarcerated.

"I want my Lord to take note of the perjury that has been committed by the 2nd plaintiff (Udofia) in this case.

"I urge you to send Udofia to prison for perjury, for claiming that no other case has been filed on this matter," he said.

Background

An FHC in Uyo had, on November 14, rescinded the nomination of Mr. Udofia as the candidate for the governorship of the APC in Akwa Ibom.

Judge Agatha Okeke, in Mr. Enang's lawsuit, ordered the APC to hold a new gubernatorial primary within two weeks, but barred Mr. Udofia from participating in the new primary.

But Mr. Udofia had filed an appeal bearing the mention: CS/C/370/2022 to challenge the judgment of the FHC.

Mr. Enang, former special adviser to President Muhammadu Buhari on the Niger Delta, also urged Judge Nwite to dismiss the lawsuit for lack of prosecution diligence.

The development follows a request for a time field extension by Umeh Kalu, SAN, who appeared for Mr. Udofia on Tuesday.

NAN reports that the APC and Mr. Udofia had sued the Independent National Electoral Commission (INEC) as the sole defendant in the case before Judge Nwite.

Mr. Udofia had requested an order that would compel INEC to accept his name as the APC gubernatorial candidate for the 2023 Akwa Ibom poll.

He also requested an order directing the commission to publish his name as submitted by the party.< /p>

The court, after hearing the parties involved, had set October 6, 2022 for the judgment.
