2023: Court dismisses lawsuit challenging Stella Oduah's senatorial candidacy

A Federal High Court in Abuja on Tuesday dismissed an action seeking an order invalidating the nomination of Stella Oduah as the People's Democratic Party (PDP) senatorial candidate in Anambra State.

The judge, Inyang Ekwo, dismissed the lawsuit for denial of status.

The News Agency of Nigeria (NAN) reports that the case was brought by John Emeka, a candidate in the May 27 primary election organized by the PDP and monitored by the Independent National Electoral Commission (INEC).

The PDP was the 1st defendant, while the INEC was the 3rd.

Mr. Emeka alleged that Ms Oduah lied under oath in her expression of interest and nomination forms, including the INEC CF001 form she submitted to INEC, for the 2023 Anambra North District elections .

In the originating summons marked: FHC/ABJ/CS/841/2022 dated and filed on June 8 by his lawyer, Mbanefo Ikwegbue, Mr. Emeka asked the court to declare that the information provided by Ms. Oduah in his INEC form CF001, regarding his participation in the National Youth Service Corps (NYSC) program, was false.

He said the senator had, under oath, used the same information to contest the previous general elections as the PDP candidate in the 2015 and 2019 elections for Anambra North District.

According to him, the act violates NYSC Sections 12(1)(a)(b)(c) and 13(1)(a).

He further requested the court to declare that due to "false information" provided in her INEC CF 001 form regarding her participation in the NYSC program, she was not qualified to run for said election and/ or any other election to the Nigerian Senate.
