APC asks court to overturn NNPP guber's victory in Kano

The Kano State branch of the All Progressives Congress (APC) has challenged the statement by the Independent National Electoral Commission (INEC) that Nigerian New People's Party (NNPP) candidate Abba Kabiru Yusuf has won the state gubernatorial ballot.

In a petition filed by its legal adviser, Abdu Fagge, in the state governorate electoral court, the APC said NNPP candidate Yusuf was not qualified to contest the election.

The party based its argument on the fact that the name of the governor-elect did not appear on the list of NNPP members sent to INEC before the elections. In the five-volume petition, he alleged that the NNPP failed to win the election with a majority of the legal votes, claiming that some of the votes cast for the ruling APC were invalidated.

The petitioner claimed that if the nullified votes were removed from the total votes by NNPP, APC would have the highest number of votes cast. In the petition, the APC also alleged that the Kano Resident Election Commissioner (REC) was wrong to declare Yusuf the winner in the first place, especially when the head margin is not greater than the spoiled votes, insisting that the election should have been declared inconclusive.

The petitioner also asks the court to declare the APC the winner of the election, having obtained the highest number of votes cast if the invalid votes are removed from the legal scores of the NNPP.

The petitioner also asks the court in the alternative to declare the election inconclusive, alleging that the advance margin is not greater than the invalidated votes.

Meanwhile, reacting to Gawuna's dismissal, APC Secretary of State Ibrahim Zakari Sarina said the decision was personal to the party. On whether the decision had anything to do with the apparent act of engineering Gawuna's defeat, Sarina insisted that the deputy governor did not accept APC's defeat in any form.

"Congratulating is different from accepting defeat. Gawuna actually congratulated the NNPP gubernatorial candidate out of his own volition. He did not do so on behalf of APC. The decision was personal,” he said.
