CAS lifts OM transfer ban but ordered to pay Watford £2.3m for Gueye transfer

July 21 - Senegalese Pape Gueye, or his new club Olympique de Marseille, have been ordered to pay Watford £2.3million in compensation for breach of contract.

The decision of the Court of Arbitration for Sport (CAS) confirms a decision rendered by the FIFA Dispute Resolution Chamber on November 25, 2021.

The CAS ruled that Gueye had breached his contract with Watford and made Gueye and OM jointly and severally liable for compensation to Watford. The CAS declared that it considered OM: as having incited the Player to break his contract with his former club".

Gueye was also sanctioned with four months without playing official matches, while OM were banned from transfers for two windows.

OM's transfer ban was lifted but Watford, who had also appealed against the decision, asking for an increase in compensation, lost their appeal.

The CAS said in a statement: "After considering all the evidence and arguments advanced by the parties in all three sets of proceedings, the Panel has reached the same conclusion as FIFA RDC in determining that the Player has effectively terminated his contract with Watford FC without cause and that compensation of £2,307,875 should be paid to Watford FC by the Player and OM jointly and severally. However, the CAS Panel has determined that OM has in fact rebutted the presumption of incitement and canceled the disciplinary sanction imposed on OM."
