Court sets for October 12 to hear alleged false certificate case against Tinubu, APC, INEC

A Federal High Court in Abuja has set Thursday October 12 for a hearing in an action to disqualify All Progressives Congress (APC) presidential candidate Bola Ahmed Tinubu from running in the 2023 elections for allegedly forging certificate.

The trial judge, Judge Obiora Egwuatu, set the new date to allow the parties to the lawsuit to complete the filing of their pleadings and exchange them as required by law before the adjourned date.

When the matter arose on Thursday, the Action Alliance (AA) attorney who filed the lawsuit, Mr. Ukpai Ukairo, informed the court that he had just received the preliminary notice of objection of Tinubu asking the court not to hear the case against him on various grounds.

Among the grounds, Tinubu claimed that the basis of the certificate infringement action against him was rooted in the 1999 election forms he submitted to the then election body.

He also claimed that the report of the Lagos State House of Assembly which questioned him about the alleged falsification of certificate is the main basis of the new lawsuit and, therefore, has become statute-barred.

However, the Action Alliance lawyer, Ukairo informed the court that Tinubu's claims, especially on the prescribed position, would be adequately addressed in the subsequent proceedings and further told the judge that the Tinubu's claims made orally by his attorney had to be made formally and served to enable him to respond appropriately.

While the Independent National Electoral Commission (INEC), which is the 1st defendant in the lawsuit, requested time to respond to the lawsuit, the APC was not represented in court despite proof of service of the chase.

The trial judge, Judge Egwuatu, then adjourned the case until October 2, for the parties to put their houses in order for a proper hearing of the alleged false certificate suit and also ordered the plaintiff to be ready to call his witnesses on the adjourned date in order to establish his case against Tinubu.

The Action Alliance had asked the court on June 21 to prevent the CENI from including the name of the APC in the ballot for the 2023 presidential election on the grounds that the APC and its candidate for the presidency, Bola Tinubu, are not qualified to participate in the presidential election of 2023 on an alleged forgery committed by Tinubu in 1999.

The lawsuit filed on behalf of the plaintiff by his attorney, Mr. Upkai Ukairo, alleged that Tinubu forged his certificate from the University of Chicago which he submitted in 1999 to qualify for the election of Governor of 1999 in Lagos State, won by Tinubu.
