EFCC has no power to meddle in state affairs - Agbakoba

A former chairman of the Nigerian Bar Association (NBA), Olisa Agbakoba, claims that the Economic and Financial Crimes Commission, EFCC, lacks constitutional support to interrogate state accounts.

Agbakoba made the revelation Thursday in Lagos State.

He said the National Assembly had not amended Article 214(1) of the constitution of the Federal Republic of Nigeria, a legal instrument establishing the Nigerian Police to incorporate the function of the EFCC.< /p>

“So the question is if the feds create the EFCC, can they then prosecute state offenses?

“The Supreme Court, in many of its decisions, has ruled that federalism means two self-governing and independent governments and, if that is correct, the EFCC has no right to go to the state and 'examine its accounts,' he said.
