Kaduna Governorate: Court admits BVAS machines as exhibits

About 316 Bimodal Voter Accreditation System (BVAS) machines were tendered and admitted as exhibits during the ongoing session of the Governorate Election Petitions Court on Tuesday in Kaduna.

The BVAS machines were admitted as exhibits on the basis of the subpoena to the Independent National Electoral Commission (INEC) to bring before the court the said elements as applied by the 1st and 2nd applicants, Isa Ashiru and the People's Democratic Party (PDP) through their lawyer, Samuel Atung (SAN).

Yusuf Zubairu, who was in court on behalf of the Commission (INEC) made a sworn statement before the clerk of the court on July 25, 2023, to present the BVAS machines of 19 local government areas of the state.

In its court deposition, the Commission was ordered to demonstrate how the machines were used to collate election results in the state during the last gubernatorial ballot.

Zubairu, who is on the INEC staff at the ICT/voter research department, testified that the Irev results were an accurate reflection of the votes cast in the state gubernatorial election dated March 18, 2023.

INEC staff added that BVAS machines cannot be tampered with before, during or after the election, just as they explained to the court that each machine has its unique identification numbers.

The witness, while protesting, using one of the machines, told the court that Voting Unit 050 in Makera ward in Kaduna South LGA had 715 registered voters in total, but only 107 voters were accredited for the election.

Earlier before the court accepted the request of the lawyers of the 1st and 2nd applicants, Chief Duro Adeyele (SAN), who is the lawyer for the Governor of Kaduna State, Uba Sani, objected to the admissibility of the BVAS machines through the intermediary of the witness.

The lawyer also argued that the witness's testimony did not indicate that the witness (Yusuf Zubairu) would open and demonstrate the BVAS machine in court, saying, "the demonstration of the BVAS machine does not does not appear in the witness statement".

In his counter argument, the lawyer for Ashiru and PDP explained that the Commission was subpoenaed to bid and demonstrate the machine in court.

The court adjourned the case to Wednesday, July 26, 2023, for further hearing
