Kwara SDP faction chairman sues national excos and others

The pioneer chairman of the Social Democratic Party in Kwara State, Comrade Ibrahim Yahaya, has taken 18 national and state leaders of the party to court over control of the party structure in the state.

Some of the defendants in the lawsuit, numbered FHC/IL/CS/40/2022, filed in the Federal High Court in Ilorin on July 8, 2022, included SDP National Chairman Dr. Olu Agunloye; the national secretary; Alhaji Shehu Gabam; the Independent National Electoral Commission; Hon. Bashir Bolarinwa, and the chairman of the Kwara SDP faction, Alhaji Azeez Afolabi (and other members of his leadership).

Yahaya and three other members of his SDP faction - Oluwole Bello (Secretary), Adelowo Julius (Treasurer) and Iyabo Rachael (Female Speaker of Parliament) seek a perpetual injunction restraining the first through fifth defendants and their agents to recognize and accept Azeez Afolabi and other members of its faction leaders; and other SDP members of the executive committee at all state levels as SDP officials at the state, local government and ward levels, based on the election conducted at the so-called congress State Party of the SDP on April 26, 2022.< /p>

Plaintiffs also seek an order of perpetual injunction restraining the First through Fifth Defendants and their agents from acting or giving effect to any resolution(s), decision(s) and activities such as the election of delegates and the primary election conducted or conducted by the Azeez Afolabi and other defendants; and other SDP members of the executive committee at all levels of the state as SDP officials in the state sequel to their elections conducted at the so-called SDP state congress held on April 26, 2022.

They also seek an order of perpetual injunction preventing Afolabi Azeez and his faction leaders (and other SDP executive committee members at all state levels) from impersonating SDP officers on the basis of their so-called elections conducted at the so-called SDP State Congress held on April 26, 2022.

Similarly, the plaintiffs also sought a court order directing the first through fifth defendants to "recognize the plaintiffs as members of the state executive committee, members of all local governments and the ward executive committee of the SDP faction led by the first plaintiff (Ibrahim Yahaya) in their respective offices, which include the President, Secretary, Treasurer and President of the State respectively.”

The lawsuit, which was filed on behalf of the plaintiffs by their attorney, Solomon Afolabi, was supported by a 43-paragraph affidavit filed by Comrade Ibrahim Yahaya.
