PDP warns contender to stop legal action against Adeleke

The Peoples' Democratic Party (PDP) has warned Dotun Babayemi to cease all legal action against the governor-elect, Ademola Adeleke, in the general interest of the party. Mr. Babayemi participated in the PDP primary in Osun which produced Mr. Adeleke as its candidate in the July 16 election.

Mr. Adeleke defeated incumbent Governor Adegboyega Oyetola of the All Progressives Congress in the gubernatorial election.

The warning is contained in a statement signed by Acting Osun DPP Chairman Akindele Adekunle on Sunday in Osogbo.

The party, in the statement, specifically disapproved of “the former contender's apparent attempt to become a tool of the APC to truncate the PDP's landslide victory in the gubernatorial ballot.”

He described as worrying Mr. Babayemi's refusal to heed calls from 'elders' of his group urging him to end the legal challenge to the PDP primary in Osun.

"While the aspirant had filed multiple cases and failed to overturn the party's due process ruling, the party noted that the latest ruling by the Court of Appeals is expected to end other primary disputes.

“Any decision to pursue the issue will smack of openly anti-party activity and direct disrespect for the people of Osun State who voted overwhelmingly for Senator Ademola Adeleke,” said he said.

The party described as a very dangerous and self-destructive dimension the alleged collaboration between Mr. Babayemi and the APC to pursue the case, saying that such an evil alliance would end in another legal defeat.

"From the start of the litigation until now, it was evident that the contender was hanging on for straws as the primary that produced Senator Adeleke fulfilled all applicable legal regulations and requirements as per law. election, among others," the statement read in part.

However, the other primary held at the Women and Children Development Initiative Foundation (WOCDIF) Center in Osogbo produced Mr. Babayemi as the winner.

In a list of candidates published later by the Independent National Electoral Commission (INEC), Mr. Adeleke appeared as the flag bearer of the PDP.

Mr. Babayemi, however, went to the Federal High Court in Osogbo, challenging the PDP's nomination and submission of Mr. Adeleke's name to the INEC and the validity of the gubernatorial primary being conducted at the stadium.

Mr. Adeleke went on to win the gubernatorial election on July 16 with 403,371 votes to defeat his closest rival, Mr. Oyetola, the APC candidate, who received 375,027 votes.

"Seeking Justice"

But in response, the Babayemi campaign organization said the remedy sought from the court was not to truncate the PDP's victory in the recently concluded gubernatorial election, but rather to ensure that it results in good governance.

The campaign organization, in a statement signed by its director, Oladiran Ojedele, said Mr. Babayemi was seeking justice to claim his mandate.

He said "after exploring all internal party mechanisms to no avail, the option left as set forth by the party constitution is to seek justice through the judiciary.

“Our symbol, Prince Dotun Babayemi, does not seek to truncate the PDP victory, but he seeks justice, seeking to claim his mandate in court.

"Is such a legal trajectory misplaced? For all those who are now crying wolf, what sincere efforts have they made to ensure that the PDP is not exposed to litigation?

"At this point, we want to assure everyone that Prince Dotun Babayemi is a genuine and bona fide member of the PDP who will not overwhelm the wishes of the people at any cost.
