Court rules Monday on Baba Ijesha's bail request

A Special Offenses Court in Ikeja will rule on Monday on a bail application filed by Olanrewaju James, also known as Baba Ijesha, if the convict encountered special circumstances for the court grants him bail.

Judge Oluwatoyin Taiwo set the date after hearing arguments from the prosecution and defense counsel.

The bail request follows the prison sentence handed down to Baba Ijesha by Judge Taiwo, who sentenced him to a concurrent five-year prison term.

However, his legal team is in court to appeal the judgment.

When the matter was raised on Wednesday, one of the defendant's lawyers, Chukwudi Adiukwu, told the court that the team had been placed on bail pending trial. appealed pursuant to Section 6(6) of the 1999 Constitution. and Section 51 of the Law of the High Court of the State of Lagos, Administration of Criminal Justice Act, admitting the plaintiff to a bail, either unconditionally or on reasonable terms.

Speaking on the particular circumstances, Adiukwu explained that the application was filed before Judge Taiwo, as it may be difficult to obtain a date at the Court of Appeal given the number business in court.

He said that with the months in prison schedule, the convict would have served his five-year concurrent prison sentence within three years and six months before the hearing could take place at the Court of Appeal.

He added that Baba Ijesha had behaved well in court during his trial, and was never absent until the judgment.

He therefore urged the court to take into account the particular circumstances in granting bail to the condemned.

Reacting to this, state prosecutor Omowunmi Bajulaye-Bishi said the defense attorney in his address failed to establish the specific circumstances that could grant release under surety to Baba Ijesha; therefore asking the court not to grant bail to the condemned.

Judge Taiwo has adjourned until September 19, 2022 to render his decision.
