FG calls on MDAs to adopt data protection laws

The Federal Government has directed all Government Ministries, Departments and Agencies to comply with the provisions of the Nigerian Data Protection Regulations.

The directive was contained in a service-wide circular published and dated November 7, 2022, under reference number SGF/OP/l/S.3/Xll/186.

Babatunde Bamigboye, Head of Law Enforcement and Regulation, Nigerian Data Protection Bureau, said in a statement on Thursday in Abuja that the circular signed by Federation Government Secretary Boss Mustapha , was to be implemented with immediate effect.

He said the circular provided that MDAs should appoint appropriate officers as data protection officers who would regularly advise management on their organization's data processing activities and ensure compliance with the provisions of the NDPR and all matters relating to the protection of privacy, rights and freedoms of data subjects.

They are also mandated to forward the name and contact details of DPOs to the Nigeria Data Protection Office for documentation and required initial training.

Others are: "Appoint approved data protection compliance organizations that will guide MDAs through compliance and file their annual reports with the NDPB.

“Make an appropriate budgetary provision for the annual data protection audit compliance process and capacity building for data protection officers and other staff.

"On an annual basis, file the report of their data protection audit with the NDPB no later than March 30 of each year.

"The implementation of the circular is with immediate effect," Bamigboye said.

Speaking on development, National Commissioner and CEO of NDPB, Dr. Vincent Olatunji commends the Federal Government for taking this historic step towards promoting the fundamental rights and freedoms of Nigerian citizens and residents, especially in the field of privacy.

Olatunji said, "As a government agency, we are encouraged by this development as it clearly demonstrates the readiness of public sector organizations and officials to provide an enabling environment for the growth of our digital economy.

"With this circular, over 200 million Nigerian citizens now have an additional reference to call for help to protect lives and livelihoods in a data-driven ecosystem.

“The Bureau will continue to engage with stakeholders so that the many benefits of lawful data processing, such as job and wealth creation, can extend to every nook and corner of Nigeria.

“MDAs may wish to inquire at the NDPB Headquarters at No. 5 Donau Crescent Maitama, Abuja or visit www.ndpb.gov.ng,” he said.
