Smells of Progress: Maryland Bans Police Searches Based on the Scent of Marijuana
Maryland lawmakers passed a bill proposed by Del. Charlotte Crutchfield, which prevents police from searching someone solely for possessing or smelling marijuana.
The Senate passed the bill with one amendment, and the House passed it 101 to 36 before the end of the legislative session.
Strong points Maryland's new bill prohibits law enforcement officials from stopping or searching an individual, vehicle or vessel solely because of the smell or possession of cannabis without additional proof of intent to distribution. The bill also prevents police from searching certain areas of a car or motor vehicle during impaired driving investigations. The bill aims to reduce the fine for public consumption of cannabis from $250 to $50. The bill, along with a broader cannabis trade measure, was sent to Governor Wes Moore (D). On Monday, the governor's office told Marijuana Moment that the governor plans to approve marijuana sales legislation.Photo by Elly Johnson on Unsplash
